Below is a public response to Dave Thune since I'm allowed only 2 comments on e-democracy.org.
Dave Thune,
The city council may not need to change the law requiring a medical response position 24 hours at spas. We can make an exception for each individual "Super Spa" company that wants to do business in St. Paul.
Perhaps a little work is required to resolve this issue on the city council on behalf of the citizens.
You've already admitted to being involved in initiating the law many years ago for ulterior motives.
Which is worse, taking a moral stand against smut despite the "pimp's lawyers", allowing an exception to be registered in law for Super Spa companies, and worrying not what anyone might say about it
or
not allowing an exception, taking a weak moral stand (protector of virtue?) and denying legitimate healthy new business in St. Paul which citizens are asking for?

Update 7/26/09
Now I'm thinking let's just remove item 12 without adding anything. We can remove item 12 and retain safety, accountability, and the ability to prosecute prostitution efforts, because of the 1996 expanded Caremark ethical/fiduciary responsibilities of directors in Delaware.
Background:
http://www.weyerhaeuser.com/Company/Media/Speech?dcrID=sp_100320031
http://en.wikipedia.org/wiki/Caremark_(court_decision)
"A director's obligation includes a duty to attempt in good faith to assure that a corporate information and reporting system, which the board concludes is adequate, exists, and that failure to do so under some circumstances may, in theory at least, render a director liable for losses."
http://www.google.com/search?source=ig&hl=en&rlz=&q=Caremark+duty+of+care+&btnG=Google+Search
Supposedly, corporate officers are now subject to Caremark responsibility. Health club owners have yet to be named specifically. But a case can be made...

Crime incident 4/25/08 - Fabulous Fern's ATM almost removed
Delton Digest Exclusive!
Neighborhood Watchdogs are looking for 2 hispanic or white males in a dark two toned Astra-Van this morning who fled the scene after removing Fabulous Fern's hallway ATM halfway through the west doors of the Blair Arcade on Selby and Western at the west end of the building.
The crime happened sometime before 4:50 AM Friday 4/25/08.
A slight man in glasses and dark wavy tousled hair in his early 50's was yammering at the street corner in an english accent and met by authorities but he was no help.
I was awoken by a Medical Emergency vehicle which for some reason did not immediately pick up the english guy because he was still talking to the perimeter police as I arrived. I did not know the guy but he asked me in an earnest way if I heard an ambulance right after I said I heard an ambulance. The policeman finally radio-ed he was off his meds and bring in a Medical emergency vehicle. I left and then later walked back to the intersection and talked a little more with the policeman. I went over to the west side of the building to see the ATM, talked a little with the Ferns key-holder, and then came home to write this report.
The vandalous potential thieves left a key peice of evidence behind .. and only the true vandals would know what it is!
My neighborhood never sleeps - there is always someone on an early morning jog or walk to disrupt criminals and report to the police.

Tax Cut Rally, Ethanol, Neat IP blogs, making MN a No-Income-Tax State
** Updates
Michele Bachmann mimicking the Democrats - hilarious fun humor - salient point made :
** posted on e-democracy.org in Minnesota Politics section **
How convenient Star Tribune reporter Jean Hopfensperger's 1,000 attendee estimate is exactly 2/3 the media's estimate of the last local protest the Sept 15 peace/appeasement rally - 1500.
Maybe we should also kneel when we're next to you lefties so it doesn't look like we're taller than you.
We had at least 5,000 at the 2008 April 12 taxcut rally. Thanks to all the lefties who attended this family event - everyone can agree on taxes.
I wonder if Jean Hopfensperger is the one who asked me how high taxes specifically affect me. As if only those on the dole have legitimate right to protest and those with no monetary interest in subsidies sit at the childrens' table. At any rate none of my comments to her made it to her very brief article.

Best speech? Michele Bachmann, hands down. Reciting a laundry list of what the Democrats say we're doing wrong:
You're driving too much!
You're using the wrong light bulb!
You're causing the energy crisis!
..
The problem is not you - the problem is nanny-state liberals in our government!
Great pictures at http://www.ktlk.com/.
Jason Lewis once said he advocated anarchy to deal with the Democrats. Although he later described it as hyperbole, I would describe what he meant as: it is not enough to dislodge those democrats at the highest levels - we need to dislodge those influential sometimes grassroots
democrats who know every democrat or who help leading democrats decide policy - sometimes behind the scenes.
The union leaders, the MN Chamber, the high level senators handling the budget - these are among the people with true power that are failing us year after year by not responding to tax cut demands.
The frustration among stay-at-home republicans in 2006 was misdirected. It is not the Republican leaders who failed to try - it was the minority Democrat handlers who behind the scenes screwed things up time and time and again - for Carlson, Jesse, and Pawlenty.
Their single principle, besides self-preservation, was to maintain the ability to raise taxes at all costs. Meaning the ability to raise taxes and still show their face. And when the freshman 2006 Dems came in the freshmen were made to toe the line and raise still more taxes - albeit
this time they were at least granted the freedom to propose any tax consuming legislation they wanted. The freshmen Dems in 2006 could cobble together any legislation on their own but without the help of the party draftsman apparently (search on Restroom Access Act).
Marty Seifert is my hero. The dragon of tax-and-spend legislation has been slayed (or slaked with a $6.6 B payoff). To the extent it is slayed Marty Seifert alone should get most of the credit.
As a result of listening to Jason Lewis (listening which local democrat Mike Fratto paternally warned against in emails to m e-democracy.org account) I am withdrawing my support of further ethanol subsidies. With mounting evidence showing ethanol is inefficient, corrosive to pipelines, and harms the economy, yet again government proves it lacks the judgment to recognize the best approach to solving problems.
I'm not sure I'll run again but FWIW here is my revised platform:
I oppose all subsidies and all entitlements. I oppose all non-constitutional federal government roles - including education, most existing regulation and all new regulation.
I support all free trade agreements with all countries except criminal dictatorships.
Bush accomplished much.
Let's take the best of all states' healthcare plans (esp WI) all the while preserving our unique healthcare arrangement.
** Let's do nothing on the housing crisis - we can only excacerbate the problem. **
I support the governing philosphy of the 9 states that have implemented an income-tax-free funding mechanism - TX FL WY NV SD TN WA NH AK.
Alaska, Florida, Nevada, South Dakota, Texas, Washington and Wyoming. Two others, New Hampshire and Tennessee, tax only dividend and interest income. http://www.govspot.com/know/incometax.htm
I support implementing a no-income-tax funding mechanism here in MN.
It is a great way to encourage children to stay here and provide care and help to their aging parents without worrying about the cost of living here.
Finally, a bunch of neat IP blogs I discovered on a complicated Slashdot.org story about a Cisco exec caught blogging about a subject for which he was responsible at work - IP.

**Name of Ward corrected, "who anonymously blogs" inserted, "sometimes" inserted, East TX inserted.
I realize the behavior of T. John Ward and others is free-enterprise, and might be protected by the law, but I encourage bullying business behavior to be challenged at every turn and therefore side with the Cisco exec who anonymously blogs and the bloggers bravely covering this story.
Ward and others basically control or represent those who control sometimes inane patents and selectively sue only large companies in violation. Their court appointments occur in East Texas. Such a business model has got to be condemned by everyone!

Minnesota Tax Cut Rally April 12 High Noon Capitol Steps- Saturday!
Hi Friends,
I hope you can attend, Saturday at high noon at the capitol steps, the Minnesota Tax Cut Rally, our humble effort to instill fiscal responsibility into our legislators and representatives. If your rep claimed as much in per diem expenses as our Democrats, Pappas and Mee Mou, did, you'll want to go!
http://extras.twincities.com/car/perdiem/perdiem.htm
District Last Name First Name Middle Per diem Mileage Other compensation Total compensation
67 Moua Mee $21,954.00 $0.00 $4,480.24 $26,434.24
65 Pappas Sandra L $19,872.00 $705.68 $4,379.77 $24,957.45
65B MARIANI CARLOS $10,703.00 $1,155.00 $154.00 $12,012.00
This in addition to consistently supporting tax increases year after year.
Here is part of my retort to a Democrat's accusation on a local community email server that I'm not willing to pay "my fair share":
Do you think we don't know the difference between the responsibility to pay
yearly taxes and the recognition of unjust regular tax INCREASES?
A sales, income, or property tax (opposed to user-fees) applied to all
residents should NEVER HAVE to be increased. It is a RATE. Do you know what a
rate is? It is a formula applied to all people. Tinker too much and the number
of people we can apply it to is reduced. Before making foolish public
statements, Andy Driscoll, learn basic mathematics.
Why do you think the US Census stopped breaking down the States' sales tax
figures into per capita (average tax paid by each person in each state) in
2006? It is an attempt to obscure Democrats' methods and the growing amount of
sales tax exacted from the people. With math, we can compare the MN current
sales, income, or property tax rates to past rates, to the tax rates of other
states, and to projected future scenarios. From that info we decide where best
to invest, shop live, and "sin" (smoke and drink). That's the United States.
The crises invoked by Democrats are manufactured to increase some tax rate. You
make it sound like the current $1B (B is billion, shorthand) deficit crisis is
people questioning to pay the regular unchanged tax rate. Noone is suggesting
that. When the Democrats use a surplus to expand/increase the size of the
Health and Human Services 20%, they are engaged in DECEPTION and COERCE the
next session to cut elsewhere to preserve that 20% expansion. Do you know what
DECEIT and COERCION is, Andy? Of course you do.
It's deception like you're peddling here that drives conservatives to the hard
right refusing to pay ANY tax.
The HF2800 transportation bill is not a sincere solution to crumbling
infrastructure. If it was, the Democrats would never have snuck it in
immediately before the budget deficit report. 2800 does not include adequate
roads and bridge repairs in the Metro area. I worry about Lafayette bridge
scheduled for 2011 in particular. And the .25% sales tax increase for the 7
metro counties that may be approved by the county commissioners soon, ALL GOES
TO TRANSIT.
That is what I said a few months ago and I stand by it. This year's $6.6M of the socialist $6.6B "comprehensive ten-year plan" should have been part of the regularly scheduled bonding bill and the actual $7.7M bonding bill should have been cut down to less than $1.5M. The cuts should come in the bloated Health and Human Services and the Education Deptartments. The cuts need not be disruptive.
We are losing people!
West-Siders and Downtowners, let's support Republican Lisa Murphy for State Rep!
We'll see you there!
